Acceptance and definitions
These Terms of Service (the "Terms") govern your use of MISSOUT (the "Service"): our website, our Telegram and Discord channels, the order widget and any related tools. The Service is provided by MISSOUT, based in Russia ("we", "us").
By using the Service (contacting us, placing an order or accepting a remote session) you confirm that you have read and accept these Terms in full. If you do not agree, please do not use the Service.
These Terms include our Privacy Policy, which forms an integral part of them.
The Service
We provide remote tuning and optimization of your Windows PC and its hardware to improve gaming performance (Fortnite, CS2, Valorant, Apex Legends, PUBG and others). The Service is a digital service performed remotely. There are no physical goods and no shipping.
Packages and add-ons (current prices are shown on the website and may change; the price valid at the time of your order applies):
- Classic 11 - clean Windows 11 Pro install, drivers, base BIOS tuning, baseline optimization.
- CustomX - a debloated custom Windows tuned for maximum FPS and low latency.
- GamePro - everything in Classic 11 or CustomX plus full CPU, GPU and RAM overclocking with stress tests.
- Add-ons - BIOS tuning, CPU / GPU / RAM overclocking, laptop optimization.
The work is done remotely through a remote-access session that you start yourself; you see every action on your screen and can stop the session at any time.
We do not guarantee any specific FPS gain or any gain at all. The result depends on your hardware, drivers, operating system and game version. Any numbers shown on the website are indicative averages based on our general data, not a promise for your specific PC.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into this agreement. By placing an order you confirm that you meet this requirement.
How ordering works
You choose a service on the website and contact us through the on-site chat, Telegram, Discord or email. We agree on the details, you pay, and we perform the work remotely. Before any work begins you confirm that you have read and accept these Terms and the Privacy Policy.
Pricing and payment (FunPay)
Prices for international customers are shown in US dollars and are indicative; the final amount, including any applicable taxes or fees, is confirmed before you pay.
Payment for international customers is processed through FunPay, an independent third-party platform, under FunPay's own terms. MISSOUT is not the payment processor: FunPay handles the payment and holds it until the order is completed. We do not control and are not responsible for FunPay's processing, fees or availability. Payments made outside FunPay are not supported or protected. Please review FunPay's own terms before paying.
Right of withdrawal (EU consumers) and immediate start
If you are a consumer resident in the EU, you normally have 14 days to withdraw from a distance contract for services, without giving a reason. To withdraw, send us a clear statement (for example by email) before that period ends; you may use a model withdrawal form on request.
Because our Service is usually started right away at your request, before placing your order you expressly (a) request that we begin performing the Service immediately, within the 14-day period, and (b) acknowledge that you will lose your right of withdrawal once the Service has been fully performed. You confirm this with a checkbox when you place your order. If you withdraw while the work has only partly been performed, you pay an amount proportional to what has been provided.
Refunds and cancellation
For payments made through FunPay, refunds are handled by FunPay under its own rules and dispute process; we cannot control how or when FunPay processes a refund.
Once the Service has been fully performed (after you requested an immediate start, see section 06), the order is not refundable, as this is an intangible service that uses a specialist's time. A refund may still apply where the session was not carried out through our fault, or where a payment was clearly made by mistake (contact us within a reasonable time). Nothing here removes mandatory consumer rights you may have under the law of your country of residence.
Your responsibilities and remote-access consent
Before the session you agree to: install the remote-access tool we recommend, back up your important files, close windows with private messages and banking apps, and ensure a stable internet connection. You give your consent to the remote session and you start it yourself.
You are responsible for the accuracy of the contact details you provide and for the lawful use of your account and devices. We are not liable for loss or damage of data; backing up your data is your responsibility. The system can always be restored by reinstalling Windows, and a BIOS profile is saved.
Acceptable use
You agree not to use the Service for any unlawful purpose, fraud or infringement of third-party rights. Our optimization is system tuning; it is not cheats, hacks or boosting and does not modify games. We are not responsible for any action a game publisher or platform takes against your account.
Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. We do not warrant a specific performance or FPS gain, full compatibility with all future Windows or game updates, or uninterrupted availability. Examples and figures on the website are illustrative; results may vary.
Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special or consequential damages (including lost profits or lost data), and our total liability is limited to the amount you paid for the relevant order.
Nothing in these Terms limits or excludes liability that cannot be limited by law, including for fraud, gross negligence or death or personal injury caused by negligence, or any mandatory rights of consumers.
Third-party platforms
We use third-party platforms that have their own terms and privacy policies: FunPay (payment), Telegram and Discord (communication). We are not responsible for their operation, availability or policies.
Intellectual property
The website, its content, the MISSOUT brand and the methods and materials we use are protected. Ordering the Service does not transfer any rights to our software, scripts or methods.
Governing law and your consumer rights
These Terms are governed by the law of the Russian Federation. However, if you are a consumer, this choice of law does not deprive you of the mandatory protection of the law of your country of residence, and you keep the right to bring a claim before the courts of that country where the law allows.
Complaints and dispute resolution
If you have a question or a complaint, please contact us first at missoutgg@gmail.com; we aim to reply within a reasonable time and resolve the matter. As a consumer, you may also contact the consumer-protection authority in your country, and EU consumers can use the European Consumer Centres Network (ECC-Net).
Changes to these Terms
We may update these Terms. The version in force at the time of your order applies to that order. The date of the current version is shown at the top of this page.
